Here are the terms and conditions included in our digital agreement and waiver! This is about a 5-minute read and will tell you pretty much everything you need to know about what you’re diving into.
The one sentence version of our terms and conditions: The main thing to keep in mind is that currently all CYH programs have no 3 or 12 month terms and are on month-to month agreements, you agree to be nice, and please don’t sue us.
YOUR MEMBERSHIP WILL AUTO RENEW UNLESS… Your membership will renew automatically for the same duration and rate, unless you advise us of your desire to terminate your membership over the phone or in person at least two weeks in advance of your renewal date. NO AUTO RENEW FOR CHALLENGES!
ALL SALES ARE FINAL(-ish).All sales are final. New Memberships have a no risk, 30-day guarantee. As a first-time CYH Striver who has not previously had a CYH membership, you may terminate your agreement and receive a complete refund within 30 days of your first class or semi-private session. We want to be your home for health and fitness, but if you’re not having a good time in the first month, just let us know and we’ll help you find a better fit.
USE THEM OR LOSE THEM. With your Membership, you have been allotted a specified number of semi-private training sessions to access each month. During the term of your agreement, a new allocation of credits are available for your use every month, starting with your monthly auto-payment and expiring on the same day of the following month. Your unused credits will not carry over, so plan in advance, and use it!
YOUR AUTO-PAYMENTS OCCUR MONTHLY. You will be billed monthly, unless you have pre-paid your Membership. A charge of $25 will be made for any checks/payment returned due to non-payment. CYH may change membership terms and rates under this agreement by posting notice of such change at least 30 days in advance of such change.
IF YOU DECIDE TO TERMINATE DOWN THE ROAD… Though we’d be sad to see you go, we’re committed to making the divorce as painless as possible. After completing the Membership Termination Form with a member of the CYH staff, please allow two business days for us to process your request.
TERMINATING AT THE END OF YOUR CURRENT AGREEMENT. Your contract is set to automatically auto-renew at the end of your 3-month or 12-month term so that you will have continual access to your semi-private sessions. If you do not wish for your agreement to auto-renew, you must fill out a termination request no later than two weeks prior to the first auto-payment of what would have been your next term. Currently all CYH programs have no 3 or 12 month terms and are on month-to month agreements.
TERMINATING A MEMBERSHIP EARLY. Early termination of a 12-month contract is a flat fee of $350, except for the “no-fee” reasons listed below. Strivers on a 3-month agreements may not terminate early, except for the “no-fee” reasons listed below. The termination will apply to future payments only. “NO FEE” TERMINATIONS. If you have a medical issue that prevents you from utilizing your membership, you may be allowed to terminate without penalty by providing a note from your doctor detailing the medical necessity of the termination. If you move and your new home is more than 25 miles from CYH, you may terminate without penalty, provided that you lived within 25 miles of CYH at the time you began your agreement. Currently all CYH programs have no 3 or 12 month terms and are on month-to month agreements.
CYH CAN CANCEL THIS AGREEMENT AT ANY TIME. CYH will pay you for unused future services. Without limiting CYH’s ability to terminate this membership for cause, CYH may terminate this membership for any reason at the end of any given month. If CYH elects to so terminate, CYH will refund a pro rata portion of any dues applicable to future month(s).
YOU AGREE TO BE NICE (DON’T BE AN @$$).You agree to keep and obey all rules and regulations now in force or in the future prescribed by CYH, for the use of CYH training facilities, premises, and equipment therein, and CYH reserves the right to revoke this membership for cause if you fail to keep and obey any such rules and regulations, or for reasons of nuisance, disturbance of other members or staff, moral turpitude (lol) or fraud. Without limiting your obligation to obey the rules and regulations of CYH presently in force or in the future prescribed, you agree to obey the policies and procedures as described in the Striver Handbook as found on the “Members” page of the CYH website.
THIS MEMBERSHIP BELONGS TO YOU. You can’t give it to anyone else. It is expressly understood and agreed that this agreement is not assignable or transferable by Striver and no rights or privileges granted by this Membership can be transferred or assigned by Striver.
NEED TO FREEZE? NO DRAMA. We make freezing (or suspending) your membership painless. After filling out the Membership Freeze Form, please allow two business days for us to process your request. Your billing will be suspended for the duration of the freeze. The billing will automatically resume once the freeze period has ended. Any suspended payments will be added onto the initial term of your agreement, extending the Membership term by the length of the freeze. Here are the details for your membership type: 12-Month Memberships: You may take advantage of four complementary freezes during the term of your agreement, anywhere from 2 weeks to 12 weeks in duration. Additional weeks will be $10 per week, paid in full at the start of your freeze period. 3-Month Memberships: You may take advantage of one complementary freeze during the term of your agreement, anywhere from 2 weeks to 12 weeks in duration. Additional weeks will be $10 per week, paid in full at the start of your freeze period. Bonus Freezing: Medical freezes are always complimentary if you provide a note from your doctor detailing the medical necessity of the freeze. You may also elect to use one of your complimentary freezes (see above), which don’t require a doctor’s note. Currently all CYH programs have no 3 or 12 month terms and are on month-to month agreements.
NEED TO CHANGE YOUR MEMBERSHIP? Want to switch things up? After filling out the Membership Change Form, allow two business days for us to process your request. 12-Month Membership Changes: Striver may change their membership type at any time, subject to current rates. The new contract must be for 12 months, and the term of the new agreement will begin again, starting with the next auto-pay date. Currently all CYH programs have no 3 or 12 month terms and are on month-to month agreements.
WE CAN TAKE YOUR PIC, ‘CAUSE YOU BEAUTIFUL. Any pictures, audio, or visual recordings taken of you at CYH or at other official CYH events may be used for publication, promotion, articles, shows, and advertisement without additional consent and without compensation. If you do not wish to allow photographs and videos of yourself to be used for promotional purposes, you must inform CYH in writing.
PLEASE DON’T SUE US (LIABILITY WAIVER) You are working on your health and fitness at your own risk at CYH premises, remotely or virtually. It is further agreed that all exercises including the use of weights, number of repetitions, and use of any and all machinery, equipment, and apparatus designed for exercising and the use of CYH premises and facilities shall be at the Striver’s sole risk. Notwithstanding any consultation on exercise programs which may be provided by CYH employees or agents, it is hereby understood that the selection of exercise programs, methods and types of equipment shall be Striver’s entire responsibility, and CYH shall not be liable to Striver or Striver’s family for any claims, demands, injuries, damages, or actions arising due to injury to Striver’s person or property arising out of or in connection with the use by Striver of the services and facilities of CYH or the premises where the same is located. CYH CAN’T BE RESPONSIBLE FOR YOUR STUFF. So leave the diamonds at home. If Striver brings any personal property onto the premises of CYH, Striver takes such action at Striver’s sole risk. Striver hereby holds CYH its successors, assigns, owners, officers, directors, employees, and agents harmless from all claims which may be brought against them by Striver, on Striver’s behalf, by Striver’s family, and Striver’s executors, administrators, and personal representatives for any such injuries or claims aforesaid and Striver for himself and on behalf or his family, executors, administrators, and personal representatives does hereby forever release and discharge CYH, its successors, assigns, owners, officers, directors, employees, and agents from all claims, demands, injuries, damages, actions, losses and expenses. This section will survive any cancellation of this Agreement.
PHYSICIAN APPROVAL: I have represented to CYH that I have either a) been given a physician’s permission to participate in the Training, or b) voluntary participate in the Training and all risks related to the Training without the approval of my physician(s). I represent that I am not aware of any medical or physical condition that would prevent me from participating in the Training or from using equipment or facilities which pose a serious health risk to me. I further acknowledge that CYH has relied on my statements as being accurate and complete, as a condition to entering into this Agreement. I further acknowledge and agree that I am not obligated to participate in any Training that I do not wish to participate in. I will inform CYH immediately if I do not wish to participate in any specific Training.
RENEWING or CONTINUING: The Striver understands and agrees, that if striver decides to continue classes or training with the trainer, to all terms and conditions of this agreement until a new contract has been signed.
I HAVE READ AND UNDERSTAND THE TERMS OF THIS AGREEMENT AND AGREE TO IT’S PROVISIONS, INCLUDING THE FACT MY MEMBERSHIP WILL AUTO RENEW FOR THE SAME DURATION AND RATE UNLESS I CONTACT THE CYH TEAM IN PERSON OR OVER THE PHONE NO LATER THAN TWO WEEKS IN ADVANCE OF THE AUTO RENEW DATE.
I ALSO UNDERSTAND THAT I AM ABLE TO CONSULT THE CYH STRIVER HANDBOOK TO REFERENCE MEMBERSHIP POLICIES AT ANY TIME.
I AM NOT UNDER THE INFLUENCE OF ANY DRUGS, ALCOHOL, OR INTOXICANTS. I AM NOT SUFFERING FROM ANY ILLNESS OR INCAPACITY.
I AM OVER 18 YEARS OF AGE.
I IS KIND. I IS SMART. I IS IMPORTANT.
I ACKNOWLEDGE THE AGREEMENT TERMS OUTLINED ABOVE AND THAT THIS IS A LEGALLY-BINDING CONTRACT AND MY DIGITAL SIGNATURE IS THE SAME AS MY FANCY SIGNATURE AND WILL HAVE THE SAME LEGAL EFFECT AS A HANDWRITTEN SIGNATURE.
